Information Required by ORS 205.125: N/A ADVANCED FINANCING OF PUBLIC IMPROVEMENTS AGREEMENT THIS Agreement is made by and between the City of Sandy, an Oregon municipal corporation (hereinafter referred to as " City") and Baltazar Ortiz, hereinafter referred to as Developer. WHEREAS, Chapter 12.14 of the Sandy Municipal Code provides for the entry into Advanced Financing Agreements between a developer and the City as authorized by the City Council and executed by the City Manager which agreement provides for the installation of and payment for ADVANCED FINANCING REIMBURSEMENT AGREEMENT PAGE 1 OF 3 .. , After Recording Return To: City of Sandy 39250 Pioneer Blvd. Sandy, OR 97055 advanced financed public improvements, and which agreement contains improvement guarantees, provisions for reimbursement by the intervening property owners who may eventually utilize such improvements, inspection guarantees, and the like, as determined in the best interest by the public by the City Council; and WHEREAS, pursuant to Chapter 12.14 of the Sandy Municipal Code, the Sandy City Council has previously conducted an informational public hearing and has given notice to intervening property owners of the pendency of the Advanced Finance Agreement; and WHEREAS, the Sandy City Council on November 20th, 2006 has previously adopted an Advanced Finance Resolution (Resolution 2006-06), which Resolution determined that $263,209.30 of the cost of installing certain sanitary sewer lines in Vista Loop Drive is eligible for reimbursement. NOW, THEREFORE, this Agreement is entered into by and between the City of Sandy, an Oregon municipal corporation, (hereinafter, "City") and Baltazar Ortiz, (hereinafter, "Developer") as follows: Section 1: Identification of Advanced Financed Public Improvements. Certain sanitary sewer improvements constructed in Vista Loop Drive are hereby identified as Advanced Financed Public Improvements eligible for reimbursement pursuant to the provisions of Chapter 12.14 of the City of Sandy Municipal code. Section 2: Identification of Intervening Parties and Methodology. Those individuals identified as intervening property owners who shall pay advanced financed reimbursement at such time as they apply for connection to advanced financed sanitary sewer, and the methodology for the determination of the reimbursement amount are set forth in Exhibit "B", attached hereto and incorporated herein by reference. Section 3: Disposition of Advanced Financed Reimbursements. Developer shall receive the advanced financed reimbursements collected by the City pertaining to the above-referenced advanced public improvements. Such reimbursements will be paid by intervening property owners at such time as the owners apply for connection to the advance financed sanitary sewer line. Such reimbursements shall be delivered to the developer for a period of twenty (20) years from and after the date of adoption of this Agreement. Section 4: Recording All Advanced Financing Resolutions shall be recorded by the City in the Deed Records of Clackamas County, Oregon. Failure to make such recording shall not affect the legality of an Advanced Financing Resolution or Agreement. Section 6: Legal Description The tax lot numbers and street addresses for the intervening properties are shown in Exhibit "B". THIS AGREEMENT entered into this day of ,2006.
