The right to the use of the water for the above purpose is restricted to beneficial use on the lands or place of use described;
however,water may be applied to lands which are not specifically described above,provided the holder of this right complies
with ORS 540.510(3).
This certificate is issued as the final increment of partial perfection of Permit S-36601,for 1.0 CFS,as described in OAR
690-320-0040.This certificate also describes the 3.0 CFS previously confirmed by Certificate 91176. This certificate
supersedes Certificate 91176.

STATEMENT
On February 23, 2018, The Water Resources Department received a request from the City of
Sandy (City)to partially perfect the use of 1.0 cubic feet per second (CFS) of water under
water right permit S-36601, which is the final increment. A 3.0 CFS portion of the authorized
rate of 4.0 CFS under Permit S-36601 was previously perfected, as described in Certificate
91176. The City of Sandy requests that a superseding certificate be issued for the entire 4.0
CFS rate under Permit S-36601 consistent with the condition in Certificate 91176.
FINDINGS OF FACT
Permit S-36601 allows for the use of 4.0 CFS of water from Alder Creek, a tributary of Sandy
River, for municipal use.
The City has requested the final increment of 1.0 CFS for partial perfection of permit S-36601
and issuance of a water right certificate. The request was accompanied by the survey required
under ORS 537.230(4). The survey shows, to the satisfaction of the Director, that the
appropriation has been partially perfected in accordance with the provision of the Water
Rights Act.
ORS 537.260 allows, without loss of priority or cancellation to the permit,the incremental
perfection of the water right permit in an amount of not less than 25 percent,pursuant to ORS
537.260 and OAR 690-320-0040.

This is a final order in other than contested case. This order is subject to judicial review under ORS

The Department finds that the City has perfected the final increment of 1.0 CFS. The quantity
of water is equal or greater than the 25 percent of the original quantity of water allowed under
permit 5-36601.
Certificate 91176 contained the following condition: "Upon perfecting a subsequent portion
of Permit 5-36601, this certificate shall be cancelled and superseded with a certificate that
authorizes a maximum rate of diversion at each point of diversion that is the lesser of(1)the
full rate of water authorized under Permit S-36601, (b) the maximum rate at which water can
be diverted for beneficial use, or(c) the amount of beneficial use."
ULTIMATE FINDING OF FACT
The City is now entitled to a certificate for the final increment in the amount of 1.0 CFS. The
Director has determined the permittee has complied with the requirements to partially perfect
permit 5-36601 pursuant to ORS 537.250 and 537.260.
ORDER
The Department finds that the final increment under permit 5-36601 has been perfected and
that a certificate in the amount of 4.0 CFS shall be issued to the City of Sandy. Certificate
91176 is cancelled and is of no further force or effect. Certificate 93884 is issued for 4.0 CFS
and supersedes Certificate 91176.
